1. Certificate of Professionals

Whenever promoter wants to withdraw the money from a separate account, Section 4 (2) (l) (d) of the RERA 2016 requires the promoter to obtain certificates from Architect, Engineer and a Chartered Accountant before any such withdrawals.

We, at PNS, will prepare all certificate of approval from the Architect, Engineer and CA for withdrawal of funds. These certificates will be prepared to adhere to all the RERA Act, Rules, Notifications and circulars issued by the concerned RERA Authorities. We will give you maximum mileage by using our knowledge and experience which will help you to make maximum withdrawals under RERA.

2. Drafting of Defect Liability Agreement

Section 14 (3) requires promoter  “In case of any structural defect or any other defect in workmanship, quality or provision of services is faced by allottee within five years by the allottee from the date of handing over possession, it shall be the duty of the promoter to rectify such defects without further charge, within thirty days. We will help you to safeguard from these losses by drafting of mitigation of defect liability agreement with all of your Contractors/ vendors like RCC, Labour Contractor, plumbing contractor, etc. to mitigate losses if any compensation arises later thereunder.

3. Quarterly Updations

As required by Section 11 (1) (b) of The RERA Act 2016, we will be doing all quarterly updations of the registered project on the website of the concerned RERA authority regarding number and types of flats, plots or garages, approvals obtained or pending, the status of project and documentation work by the authority or any other details as required by RERA.

4. RERA Audits

As per Section 4(2)(l)(k) of RERA Act, 2016 “Promoter shall get his accounts audited within six months after the end of every financial year by a Chartered Accountant in practice, and shall produce a statement of accounts duly certified and signed by such chartered accountant and it shall be verified during the audit that the amounts collected for a particular project have been utilised for the project and the withdrawal has been in compliance with the proportion to the percentage of completion of the project.”

We, at PNS, facilitate for smooth completion of annual RERA audit within due date for all the year, thereby safeguards the promoter from levy of penalty which may extend up to 5% of estimated project cost under Section 61 of the Act.

5. Vetting of all your Marketing collaterals

As per Section 11(2) of RERA Act, 2016, “The advertisement or prospectus issued or published by the promoter shall mention prominently the website address of the Authority, wherein all details of the registered project have been entered and include the registration number obtained from the Authority and such other matters incidental thereto.” Further, as per Section 12 of the RERA Act, in case customers intend to withdraw from the project due to false commitment by the promoter, the promoter shall be liable to return the entire investment along with interest and compensation. Non-compliance with the provisions of Section 11(2) shall attract a penalty of up to 5% of the estimated cost of the project as provided under Section 61 of the Act.

We, at PNS, verify the content of marketing collaterals like SMS, emails, hoardings, prospectus, brochures, leaflets, circular, etc. and suggest probable solutions that will assist in doing the right compliance thereby mitigating the risk of penalty up to 5% of the estimated cost under Section 61 of the Act.

6. Expert Professional Advice with a Quarterly Review

We will be having a quarterly review with the management, validating the RERA status of the project, discussing new circulars or cases issued by RERA. We make sure that all the queries of the clients are solved at the end of this process.

We will help you to design and implement RERA compliant accounting system, which will help to get the reports for preparation of Certificate of Professionals, RERA audit at just one click of a button. 8. RERA related Legal Advisory Services

But in case, any litigation arises with the customers, PNS offers the appropriate professional expertise depending to draw out the best solution beneficial to the client.

9. Transfer of Project

As per Section 15 of RERA Act, 2016, “The promoter shall not transfer or assign his majority rights and liabilities in respect of a real estate project to a third party without obtaining prior written consent from two-third allottees, except the promoter, and without the prior written approval of the Authority”.

 We, at PNS, help in conducting the necessary compliance relating to the transfer of project under RERA, thereby safeguarding the promoter from levy of penalty up to 5% of the estimated cost of project u/s 61 of RERA Act, 2016.

10. Extension of Project Registration

As per Section 6 of RERA Act, 2016, the registration granted under section 5 may be extended by RERA authority on an application made by the promoter due to force majeure or for any other reason without default on the part of the promoter for a period not exceeding one year.

We, at PNS, help the promoter in conducting the compliance with regards to the extension of the project through a strong liasoning support at the RERA Department for the extension certificate without any delay caused due to unrelated reasons.

11. Closure of RERA Registration

On receiving the completion certificate/occupancy certificate from the local authority, the details of the same have to be updated on the RERA web portal along with supporting documents and updates has to be done as required by Section 11 of the RERA Act 2016. We at PNS help promoter in doing the necessary compliance as per the latest procedure in the respective states of India and offers suggestions if any.
